Terms of Service

Freedom Hives · Last updated: 22 September 2026

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Freedom Hives platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who we are

Freedom Hives is operated by Freedom Hives, ABN 47 141 339 981, of Capel, Western Australia 6271.

3. The Service

Freedom Hives provides a multi-tenant platform that lets you build and host websites, landing pages, and funnels; create and sell online courses; manage contacts, leads, and customers; build forms and collect submissions; send emails to your customers; access AI-assisted tools for content and workflow; and connect your own tools and integrations.

We may add, change, or remove features at any time. We will give reasonable notice of material changes.

4. Accounts

You must create an account to use the Service. You agree to provide accurate information, keep your password secure, not share your login with others, and tell us immediately if you suspect unauthorised access.

You are responsible for everything done through your account.

5. Subscription and billing

Fees — Access to the Service is provided on a subscription basis. Current pricing is available on our website.

Payment — Subscriptions are billed in advance on a monthly or annual basis. All fees are in Australian dollars unless stated otherwise.

Late payment — If payment fails, we may suspend your access until payment is received.

Changes — We may change pricing with 30 days’ notice. If you do not agree to a price change, you may cancel before the change takes effect.

Refunds — Subscription fees are generally non-refundable, except where required by the Australian Consumer Law or as set out in this agreement.

6. Acceptable use

You agree not to use the Service to send spam or unsolicited commercial messages (as defined by the Spam Act 2003 (Cth)), upload or distribute malware, infringe anyone’s intellectual property, harass, threaten, or defame anyone, collect personal information unlawfully, break any law, attempt to access another user’s account or data, reverse-engineer, scrape, or copy the Service, or resell the Service without our written permission.

We may suspend or terminate your account if you breach these rules.

7. Your content

You own your content. Everything you upload to the Service — your pages, courses, contacts, images, videos, text — remains yours. We do not claim ownership.

You grant us a licence. By using the Service, you grant us a non-exclusive, worldwide licence to store, process, and display your content only as necessary to provide the Service to you. This licence ends when you delete the content or close your account, except where we are required by law to retain it.

You are responsible for your content. You confirm that you have the right to upload it, and that it does not infringe anyone else’s rights.

Your customers’ data. When you use the Service to manage your own customers, you are the controller of that data. You are responsible for having a lawful basis for collecting it, informing your customers how you handle their data, complying with the Spam Act if you send marketing emails, and responding to access and deletion requests from your customers. We act as your processor and handle that data only on your instructions.

8. AI features

Some parts of the Service use artificial intelligence. Where AI features are used: AI outputs are suggestions, not decisions, and you are responsible for reviewing anything AI generates before using it; AI may make mistakes, and you should not rely on AI outputs without checking them; you should not input sensitive personal information (health, financial, or identity documents) into AI features; and where an AI feature significantly affects a decision about an individual, we will disclose this in our Privacy Policy and you can request human review.

You retain ownership of any content you submit to AI features and any output generated from your content.

Money Hive financial planning tools and any AI-generated output provide general educational information and estimates based on what you enter. They are not financial, tax, accounting, legal or investment advice, do not assess your full circumstances, and are not a substitute for qualified professional advice. You remain responsible for reviewing outputs and making your own decisions.

9. Third-party services

The Service integrates with third parties such as Stripe, Resend, Cloudflare, and Supabase. Your use of those services is governed by their own terms. We are not responsible for third-party services.

If you connect your own accounts (for example, your own Cloudflare or Stripe account), you are responsible for maintaining them.

10. Availability and support

We aim to keep the Service available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable during scheduled maintenance (we will try to give advance notice), unscheduled outages or emergencies, or issues with third-party providers.

Support is available by email at support@freedomhives.com. Response times depend on your plan.

11. Termination

By you — You can close your account at any time. You will be billed for the current period and no further charges will apply.

By us — We may suspend or terminate your account if you breach these Terms, you fail to pay, we are required to do so by law, or continuing to provide the Service would harm other users or us.

If we terminate without cause, we will refund any unused portion of prepaid fees.

12. Disclaimers

The Service is provided "as is" and "as available." To the extent permitted by law, we exclude all warranties other than those that cannot be excluded.

We do not guarantee that the Service will be error-free, that your data will never be lost (please keep your own backups of critical content), or that any particular business outcome will result from using the Service.

Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) that cannot lawfully be excluded.

If you are a consumer under the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded. For major failures, you are entitled to cancel and receive a refund. For minor failures, you are entitled to a remedy within a reasonable time.

13. Limitation of liability

To the extent permitted by law, and subject to the Australian Consumer Law guarantees that cannot be excluded: our total liability for any claim arising from these Terms or the Service is limited to the total fees you paid us in the 12 months before the claim arose; and we are not liable for indirect, consequential, or special damages, including loss of profit, loss of data, or business interruption.

Nothing in this clause limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

14. Indemnity

You agree to indemnify us against any claim, loss, or expense arising from your breach of these Terms, your content infringing anyone’s rights, your use of the Service in a way that harms someone else, or your breach of privacy or spam laws in relation to your own customers.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in the Platform at least 30 days before the change takes effect. Continuing to use the Service after the change means you accept the new Terms.

If you do not agree to a change, you may cancel your account before the change takes effect.

16. Governing law and disputes

These Terms are governed by the laws of Western Australia, Australia.

If a dispute arises, we ask that you first contact us at legal@freedomhives.com so we can try to resolve it. If we cannot resolve it within 30 days, either party may take the matter to the courts of Western Australia.

Nothing in this clause prevents you from lodging a complaint with the Office of the Australian Information Commissioner (for privacy matters) or the Australian Competition and Consumer Commission (for consumer matters).

17. General

Entire agreement — These Terms, together with our Privacy Policy, form the whole agreement between us.

Severability — If any part of these Terms is found to be unenforceable, the rest remains in effect.

No waiver — If we do not enforce a right, that does not mean we have given it up.

Assignment — You may not assign your rights under these Terms. We may assign ours, for example if we sell the business.
